1 On 21 May 2020 guidance was issued that stipulated all Covid-19 or presumed Covid-19 deaths where the deceased was resident in a care home when the virus was contracted should be reported to COPFS.

2 On 21 May 2020 guidance was issued that stipulated all Covid-19 or presumed Covid-19 deaths where the deceased might have contracted the virus in the course of their employment or occupation should be reported to COPFS.

3 & 4 The guidance of 21 May 2020 applied retrospectively. The National Records of Scotland (NRS) have confirmed that the guidance applies to the deaths of 1,753 people who died in care homes before 21 May 2020. COPFS is aware of these deaths, and they stand to be reported in due course as part of a co-ordinated multi-agency approach.  Figures are regularly updated by NRS.

5 All deaths in custody are reported to COPFS, irrespective of the presence or suspected presence of Covid-19.

7 On 21 December 2022 guidance was issued that stipulated that certifying doctors no longer required to report deaths associated with COVID-19 disease (or presumed COVID-19 disease) where the only reason for reporting the death to the PF was because of the instruction contained within the earlier guidance dated 20 May 2020 i.e. the virus was contracted whilst the deceased was resident in a care home, or where it may have been contracted whilst the deceased was in the course of their employment or occupation
