Pedestrian death FAI determination published

The Procurator Fiscal notes the conclusion of the discretionary Fatal Accident Inquiry into the death of Chloe Morrison.

Chloe, 26, died on 25 October 2019 after being struck by the extended outrigger leg of a Scania lorry owned by Glenevin Ltd as she was walking along a footpath next to the A82 road at Kerrowdown, near to Drumnadrochit.  

In his determination, the sheriff noted precautions that Glenevin Limited could have taken and made several recommendations in relation to LGV and HGV fitted with outriggers.  

DETERMINATION INTO THE DEATH OF CHLOE MORRISON 

This was a discretionary Fatal Accident Inquiry instructed by the Lord Advocate as she considered that the death of Chloe Morrison occurred in circumstances giving rise to significant public concern. 

The Crown, acting in the public interest, presented evidence on the facts and circumstances of Chloe’s deaths at the FAI. 

The FAI followed the prosecution and conviction of the lorry driver for a contravention of the Road Traffic Act 1988 after trial in the High Court of Justiciary at Inverness.   

Unlike criminal proceedings, FAIs are inquisitorial in nature, and are used to establish facts rather than to apportion blame.    

Procurator Fiscal Andy Shanks, who leads on death investigations for COPFS, said:        

“The tragic death of Chloe Morrison occurred in circumstances giving rise to significant public concern and as such a discretionary Fatal Accident Inquiry was instructed. 

“Chloe’s death was a devastating loss for her family and my thoughts are with them at this difficult time.”
